These Terms will be finalised before the official launch.

These General Terms and Conditions (Terms) govern the use of the Habebe app and services.

§ 1 Scope and provider

These Terms apply to the use of the Habebe app and the associated website, operated by:

Deviating terms of the user are not recognised unless we expressly agree to their validity in writing.

§ 2 Description of services

Habebe is an app for a daily sign-of-life check-in. Once a day you confirm with a single tap that you are okay. The trusted contacts you have selected can see that your check-in has happened and are notified if your check-in does not occur within the time window you have set.

Optionally, Habebe offers features for sharing emergency and health information and — if enabled by you — for sharing your location.

§ 3 Not an emergency or rescue service

Habebe is not an emergency, rescue, security or medical monitoring service and is not a substitute for one.

  • Habebe is not monitored by staff around the clock. A missed check-in triggers a notification to your contacts, but it does not dispatch emergency services.
  • In an emergency, always contact the official emergency number directly (in Germany 112 or 110) or other competent authorities.
  • The delivery of notifications depends on factors we cannot fully control (e.g. internet connection, device settings, the push services of Apple/Google, the reachability of your contacts). We therefore cannot guarantee the timely or successful receipt of a notification.
  • Do not rely on Habebe alone in life-critical or time-critical situations.

§ 4 Registration and account

An account is required to use the service. You undertake to provide accurate information when registering and to keep your login credentials confidential. You are responsible for activities carried out via your account.

§ 5 Conclusion via App Store / Google Play, subscription

Habebe is offered with a free trial followed by a paid subscription. The applicable price and term are shown to you in the app before purchase.

The paid subscription contract is concluded via the Apple App Store or Google Play. The respective store operator (Apple or Google) is your contractual partner for the purchase; their terms of use and business terms apply in addition.

Subscriptions renew automatically for the respective billing period unless you cancel in good time before the end of the current period.

§ 6 Cancellation, refunds and withdrawal

You manage and cancel your subscription directly in the subscription settings of your Apple ID or Google Play account.

Because the purchase is processed via the respective app store, cancellation, refunds and any statutory right of withdrawal are governed by the terms of the respective store (Apple or Google) as the seller of the subscription. Refund requests should therefore be addressed to Apple or Google.

Independently of this, you can delete your Habebe account at any time in the app.

§ 7 User obligations

You undertake not to use Habebe for unlawful purposes. You ensure that the people you store as contacts agree to the use of their contact details and to receiving notifications.

§ 8 Availability

We strive for high availability of the service but cannot guarantee uninterrupted availability. Maintenance, disruptions or circumstances beyond our control may lead to temporary limitations.

§ 9 Liability

We are liable without limitation for intent and gross negligence as well as under the German Product Liability Act. For slight negligence we are liable only for the breach of a material contractual obligation (cardinal obligation) and limited to the foreseeable damage typical for the contract.

The limitations of liability apply in particular against the background of § 3 (Not an emergency or rescue service). We accept no liability for the missing, delayed or faulty delivery of notifications due to circumstances beyond our control.

Liability for damage resulting from injury to life, body or health remains unaffected.

§ 10 Data protection

Information on the processing of personal data can be found in our Privacy Policy.

§ 11 Changes to these Terms

We may amend these Terms, for example in the event of changes to features or the legal situation. We will inform you of material changes in an appropriate manner.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.

Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.

Note on consumer dispute resolution: We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
